For example, if you are transporting marijuana from a state or territory where it is legal to a state or territory where it is not legal, such as Nebraska, you must know and follow all the laws in both states.

Under federal law, an employer may not discriminate against a person on the basis of that person's status as a cardholder or activity in relation to a state-approved marijuana use program. Federal law provides no recourse for employees who are discriminated against by their employers on this basis. However, the Colorado Supreme Court has held that employers may still enforce their policies prohibiting marijuana use. Martinez v. Coors Brewing Company , 24 P.3d 1047 (Colo. 2001).



The Colorado Medical Marijuana Amendment does not prevent employers from having a drug-free workplace, and because marijuana is illegal under federal law, they can continue to prohibit employees from using it at any time.



If you are a cardholder, it is your responsibility to make sure that your employer knows what the Amendment says and does not know about your use or possession of medical marijuana in any form if it is not part of the state-approved program. It is also against the law for an employer to fire or penalize a person solely because he or she has an authorization from the state to use medical marijuana.
